The judge has ruled: Blacksburg citizens have a seat at the hearing!

When 21 residents of Blacksburg appealed the decision of the Board of Zoning Appeals to give the developers of the South Main project immunity from the provisions of Ordinance 1450, we were sure that homeowners near the site had legal standing to appeal. But the developers challenged our legal standing anyway. After a hearing and a delay of several weeks, Judge Bobby Turk, of the Montgomery County Circuit Court, has given us the expected ruling. All 21 of the appellants have legal standing to appeal the BZA's ruling.

This means that we will be full participants in the appeal, and our attorney will argue our case before the judge. And this means that concerned residents of Blacksburg will not be forced to observe the proceedings passively, but will have their interests represented in court.

The combined appeal of the Town of Blacksburg and the 21 BURG parties will be heard on Tuesday, December 18, at 9 AM, in the Montgomery County Circuit Court, 1 E. Main St., Christiansburg. The hearing is open to the public.

Now that the legal case is heating up, so are the expenses. While only 21 citizens of Blacksburg are listed in our appeal, these 21 are standing up for all of us. Their legal battle is ours, so let's give them what support we can!
